1. Purpose of This Waiver
This Participant Liability Waiver and Assumption of Risk ("Waiver") is intended to clearly define the risks associated with participation in World Junior Golf Tour ("WJGT," "we," "us," or "our") activities and to release WJGT from liability to the fullest extent permitted by law.
This Waiver is incorporated by reference into the WJGT Terms & Conditions and should be read in conjunction with the WJGT Privacy Policy and Media Release.
2. Assumption of Risk
Participation in golf-related activities involves inherent risks, including but not limited to:
- Being struck by golf balls, clubs, or equipment
- Slips, falls, uneven terrain, or course conditions
- Physical exertion, heat exposure, dehydration, or weather-related conditions
- Contact with other participants, spectators, or third parties
- Travel to and from events
Participation in WJGT activities is voluntary. The parent or legal guardian and the participant knowingly and voluntarily assume all risks, whether known or unknown, foreseeable or unforeseeable, associated with participation in WJGT activities.
3. Release and Waiver of Liability
To the fullest extent permitted by law, the parent or legal guardian, on behalf of themselves and the minor participant, hereby releases, waives, discharges, and holds harmless WJGT and its officers, directors, employees, contractors, volunteers, partners, sponsors, host facilities, affiliates, and agents from any and all claims, demands, actions, damages, losses, costs, or expenses arising out of or related to participation in WJGT activities, including but not limited to claims for:
- Personal injury, illness, or death
- Property damage or loss
- Negligence (except where prohibited by law)
This Waiver is binding on the participant, parent or legal guardian, and their respective heirs, executors, administrators, successors, and assigns.
5. Insurance
WJGT does not provide medical, health, or accident insurance for participants. Parents and guardians are solely responsible for maintaining adequate insurance coverage for the participant.
6. Indemnification
The parent or legal guardian agrees to indemnify, defend, and hold harmless WJGT from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or related to the participant's actions, omissions, or participation in WJGT activities.
7. Dual Acknowledgment and Electronic Consent
This Waiver requires a one-time affirmative acknowledgment via checkbox from:
- The parent or legal guardian, and
- The junior participant
Electronic acknowledgment, checkbox acceptance, and digital records shall constitute a legally binding signature to the fullest extent permitted by law. By acknowledging this Waiver, the parent or legal guardian confirms they have the legal authority to do so on behalf of the minor.
8. Severability
If any portion of this Waiver is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
9. Governing Law and Venue
This Waiver shall be governed by and interpreted in accordance with the laws of the State of Texas, without regard to conflict-of-law principles. Venue for any dispute shall lie exclusively in state or federal courts located in Texas.
10. Acceptance
By checking the acknowledgment box during registration, the parent or legal guardian and the junior participant confirm that they have read, understood, and voluntarily agree to this Participant Liability Waiver and Assumption of Risk.
